Documents and 30 countries exempt from consular legalization

Today, the need for consular certification of Vietnamese papers for use in foreign countries as well as consular legalization of foreign papers used in Vietnam is increasing. However, not all documents need consular legalization, there are documents that are exempt from consular legalization / certification according to Vietnamese laws or treaties. 1. List of papers exempted from consular legalization

According to Article 9 of Decree No. 111/2011 / ND-CP of December 5, 2001, papers and documents exempted from consular certification and legalization include:

    Papers and documents exempted from consular certification and legalization under international treaties to which Vietnam and the related foreign parties are members, or on the principle of reciprocity.
    Papers and documents are transferred directly or via diplomatic channels between competent Vietnamese agencies and foreign competent agencies.
    Papers and documents exempt from consular certification and legalization according to the provisions of Vietnamese law.
    Papers and documents that are not required by the Vietnamese or foreign receiving agencies to be consular legalized or consular certified in accordance with the respective laws of Vietnam or foreign countries.

2. List of countries exempt from consular legalization

Below is a table of countries that are exempted from consular legalization and consular certification along with a list of documents exempted from consular legalization and consular certification.

1. The Republic of Afghanistan

    Waiver of consular legalization / certification of papers within the competence of consular officers issued by a representative office of one country in the other country in accordance with Article 36 of the 1987 Consular Agreement with Afghanistan.

2. The Algerian People's Democratic Republic

    Waiver of legalization / consular certification of papers and documents used for the purpose of mutual legal assistance provided by competent agencies of the two sides under Article 10 of the mutual legal assistance agreement on criminal, April 14, 2010, for the purposes of mutual legal assistance and transfer to the Central Agencies in accordance with the Agreement.
    Waiver of legalization / consular certification of civil and commercial documents with the official signature and seal of the competent authority as prescribed in Article 5 of the Agreement on mutual legal assistance in civil matters and trade in 2010, for the purposes of mutual legal assistance and transfers to Central Agencies pursuant to the Agreement.

3. Republic of Poland

    Exemption from consular legalization / certification of labor papers (Article 1.3), civil, family, criminal issued, certified by competent authorities, issued by competent authorities of both parties , pursuant to Articles 14 and 15 of the 1999 Vietnam-Poland Civil and Family Mutual Legal Assistance Agreement, to use for mutual legal assistance purposes under the Agreement.

    Waiver of legalization / consular certification of papers issued by consular officers issued by a representative mission of one country in the other country in accordance with Article 34 of the 1979 Consular Agreement.

4. The Republic of Bulgaria

    Waiver of legalization / consular certification of civil documents, marriage and family, criminal issued by the competent authorities of the two sides as prescribed in Article 12 of the mutual legal assistance agreement 1986
    Exempt legalization / consular certification of papers that are under the authority of consular officers, issued by the representative office of one country in the other country under Article 33 of the Consular Agreement of 1979.

5. Republic of Belarus

    Waiver of legalization / consular certification of civil (commercial), family, labor and criminal papers issued by competent state agencies under Article 11 of the Judicial Assistance Agreement 2000.
    Exempt legalization / consular certification of papers that are under the authority of consular officers issued by the representative office of one country in the other country in accordance with Article 13 of the Consular Agreement 2008.

6. Kingdom of Cambodia

    Consular legalization of papers used for birth registration, settlement of marriages, recognition of foreign parents and children of foreigners with stable residence in border areas , granted by the competent Cambodian authorities under Clause 4, Article 2 of Decree 123/2015 / ND-CP of November 15, 2015.
    Exemption from legalization of public documents and documents used for the purpose of mutual legal assistance on civil matters by the competent state agencies of the two parties under Article 11 of the 2013 Agreement on mutual legal assistance on civil matters if transferred via a communication channel in accordance with the provisions of the Agreement.
    Exempt legalization / consular certification of papers that are under the authority of consular officers issued by the representative office of one country in the other country in accordance with Article 41 of the 1997 Consular Agreement with Cambodia.

7. Republic of Kazakhstan

    Waiver of consular legalization / certification Judgments, decisions of the Court, or excerpts of judgments, decisions of the Court or other necessary documents related to civil status of citizens of Contracting Parties competent authorities, according to Article 14 of the 2011 Civil Judicial Assistance Agreement, if transferred via contact channels according to the Agreement's provisions.

8. The Republic of Cuba

    Waiver of legalization / consular certification of civil papers, marriage, family, criminal, labor issued by the competent authorities of the two sides under Article 13 of the Agreement on civil legal assistance , labor, criminal between Vietnam and Cuba in 1988.
    Waiver of consular legalization / certification of papers under the authority of consular officers issued by the representative office of one country in the other country in accordance with Article 12 of the Consular Agreement of 1981.

9. The Democratic People's Republic of Korea

    Waiver of legalization / consular certification Documents used for mutual legal and civil judicial assistance issued by the competent state agencies of the two sides under Article 7 of the mutual legal and legal assistance agreements in civil and criminal matters in 2002 if used for the purposes of mutual legal assistance under the Agreement.

10. Taiwan (China)

    Waiver of legalization / consular certification of civil, commercial, marriage, family and labor documents (Article 1.2) with the official signature and seal issued by the competent authority, issued by the Agency The State shall have the authority of both Parties to issue according to Article 15 of the Agreement between two Economic-Cultural Offices on mutual legal assistance in the civil field if used for the purpose of mutual legal assistance under the Agreement.

11. Kingdom of Denmark

    The exemption from legalization of papers used for adoption is issued by the competent authorities of both Parties under Article 4 of the 2003 Adoption Cooperation Agreement.

12. Kingdom of the Netherlands

    Exempting the legalization of Vietnamese papers and documents that have been consular certified at the Ministry of Foreign Affairs of Vietnam by the Vietnamese competent authorities under the Official Letter HANOI / 2015-236 dated 10/12/2015 (Dai Netherlands Embassy in Hanoi) (Applies only to Vietnamese documents).

13. The Republic of Hungary

    Exemption from consular legalization / certification of public documents issued by a Contracting Party's agency or private documents notarized / authenticated such as certificates of registration, signatures or identities issued by competent authorities The rights of both parties under Article 6 of the Agreement on mutual legal assistance on civil, family and criminal matters between Vietnam and Hungary in 2018, if such documents are transferred via the communication channels according to the provisions of the Agreement.
    Exempt legalization / consular certification of documents within the competence of consular officers granted by the representative office of one country in the other country, in accordance with Article 33 of the 1979 Consular Agreement.

14. The Republic of Iraq

    Exempt legalization / consular certification of papers that are under the authority of consular officers issued by the representative office of one country in the other country, in accordance with Article 40 of the 1990 Consular Agreement.

15. The Republic of Italy

    Waiver of legalization / consular certification for adoption is granted by the competent authorities of the two countries, in accordance with Article 4 of the Cooperation Agreement on adoption between Vietnam and Italy in 2003.

16. Lao PDR

    Waiver of legalization / consular certification of civil documents, marriage and family, criminal issued by the competent authorities of the two sides under Article 12 of the Criminal Justice Mutual Assistance Agreement between Vietnam and Laos in 1988.
    Waiver of consular legalization / certification of papers under the authority of consular officers issued by the representative office of one country in the other country, in accordance with Article 36 of the Consular Agreement of 1985.
    Consular legalization of papers used for birth registration, settlement of marriages, recognition of foreign parents and children of foreigners with stable residence in border areas by Lao authorities in the border area, pursuant to Clause 4, Article 2 of Decree 123/2015 / ND-CP of November 15, 2015.

17. Mongolia

    Waiver of legalization / consular certification of civil documents, marriage and family, criminal issued by competent authorities of both Parties, in accordance with Article 8 of the Agreement on mutual legal assistance in civil matters and criminal law between Vietnam and Mongolia in 2000.
    Exempt legalization / consular certification of papers that are under the authority of consular officers issued by the representative office of one country in the other country, in accordance with Article 31 of the 1979 Consular Agreement.

18. Russian Federation

    Waiver of legalization / consular certification of documents made or certified by a judicial agency (including certified translations and excerpts) and a Judicial Agency of the two sides (a judicial agency is Courts, Procuracies and other competent agencies on civil and criminal matters (notary offices, law firms) according to the laws of the country where they are headquartered, according to Article 15 Justice and Legal Mutual Agreements on civil and criminal matters 1998
    Exempt legalization / consular certification papers under the authority of consular officers issued by the representative office of one country in the other country, in accordance with Article 29 of the Consular Agreement of 1978 (signed with the Soviet Union).

19. Japan

    Exemption from legalization / certification of civil status papers issued by the competent authorities of the two Parties on the principle of reciprocity.

20. Nicaragua

    Waiver of consular legalization / certification of papers under the authority of consular officers issued by the representative office of one country in the other country, in accordance with Article 34 of the Consular Agreement with Nicaragua in 1983.

21. Australia

    Exempt legalization / consular certification of papers that are under the authority of consular officers issued by the representative office of one country in the other country, in accordance with Article 8 of the Consular Agreement with Australia in 2003.

22. The Republic of France

    Waiver of consular legalization / certification Civil judgment / decision / civil judgment judgment, civil status papers, civil papers used for marriage, adoption, recognition of fathers, mothers, children due to Competent authorities of the two Parties, in accordance with Article 26 of the Mutual Legal Assistance Agreement on Civil Affairs in 1999 and the diplomatic note between the Consular Department and the French Embassy in Hanoi in 2011.
    Waiver of legalization / consular certification for adoption made by the competent authority and transferred to the central agency, in accordance with Article 17 of the Agreement on Adoption Cooperation between Vietnam and France .
    Exempting the legalization of documents within the competence of consular officers issued by the representative office of one country in the other country, in accordance with Article 35.3 of the Consular Agreement dated December 21, 1981. These documents must be consular certified if required by the other party.

23. Romania

    Waiver of consular legalization / certification of papers under the authority of consular officers issued by the representative office of one country in the other country, in accordance with Article 22 of the Consular Agreement of 1995.

24. The Czech Republic

    Waiver of legalization / consular certification of civil documents (including family and labor matters) and criminal matters issued by the competent State authorities of the two Parties, in accordance with Article 13 of the Mutual Assistance Agreement judicial and legal in 1982 (signed with Czechoslovakia).
    Waiver of legalization / certificate of consular papers The authority of consular officers issued by the representative office of one country in the other country, pursuant to Article 40 of the 1980 Consular Agreement (signed with Czechoslovakia).

25. Kingdom of Spain

    Exemption from consular legalization / certification of criminal papers and documents issued by competent authorities of the two Parties, in accordance with Article 21 of the Criminal Justice Assistance Agreement 2015, when transferring traffic through the Central Agencies.

26. Swiss Federation

    Exemption from legalization The papers used for adoption are issued by the Competent Authorities of the two Parties, in accordance with Article 4 of the Agreement on Adoption Cooperation between Vietnam and Switzerland in 2005.

27. The People's Republic of China

    Waiver of legalization / consular certification of civil documents (commercial, family marriage and employment) and criminal issued by the Court or competent authorities of both Parties and officially stamped, in accordance with Article 29 of the Mutual Legal Assistance Agreement on civil and criminal matters between Vietnam and China in 1998, if this document is used for the purpose of mutual legal assistance under the Mutual Assistance Agreement Judicial 1998.
    Exempt legalization / consular certification of papers that are under the authority of consular officers issued by the representative office of one country in the other country, in accordance with Article 45 of the 1998 Consular Agreement.
    Exemption from legalization of papers used for birth registration, settlement of marriages, recognition of parents, children with foreign elements, death of foreigners permanently residing in border areas issued by Co competent state agencies in the border areas, according to Clause 4, Article 2 of Decree 123/2015 / ND-CP of November 15, 2015.
    For papers such as diplomas, certificates, judicial records (confirmed without criminal records, criminal records) and other relevant documents issued by a Chinese notary public or other competent agencies (including Hong Kong, Macao) certification, then certified by the Consular Department of the Ministry of Foreign Affairs of China (or local Chinese foreign affairs agency) certified, it must be legalized at the Vietnam Representative Office in China. Quoc (Based on the content of the diplomatic note between the Consular Department and the Chinese Embassy in Vietnam).

28. Ukraine

    Waiver of legalization / consular certification of civil documents (commerce, marriage, family, labor) and criminal issued by the competent authorities of both Parties, in accordance with Article 12 of the Private Mutual Assistance Agreement law on civil and criminal issues between Vietnam and Ukraine in 2000.
    Waiver of consular legalization / certification of papers under the authority of consular officers issued by the representative office of one country in the other country, in accordance with Article 42 of the 1994 Consular Agreement.

29. Republic of Slovakia

    Waiver of legalization / consular certification of civil documents (including family and labor matters) and criminal matters issued by the competent State authorities of the two Parties, in accordance with Article 13 of the Mutual Assistance Agreement judicial 1982 (signed with Czechoslovakia).
    Exempt legalization / consular certification of documents that fall under the authority of consular officers issued by the representative office of one country in the other country, in accordance with Article 40 of the 1980 Consular Agreement (signed with Czechoslovakia).

30. Republic of Indonesia

    Waiver of consular legalization / certification of documents used for criminal assistance, except in special cases when the requested Party requests that such documents or documents be authenticated , signed by the State authorities of the two Parties, under Article 19 of the Criminal Justice Assistance Agreement between Vietnam and Indonesia signed on June 7, 2013, effective from January 22, 2016. Applies only to papers and records transferred under the Agreement.
