How to perform:

Step 1: Prepare documents as prescribed by law.

Step 2: Apply:

1. Agencies, organizations and individuals submit dossiers at one of the three working offices of the Immigration Department - Ministry of Public Security:

a) 44-46 Tran Phu, Ba Dinh, Hanoi.

b) 254 Nguyen Trai, District 1, Ho Chi Minh City.

c) 7 Tran Quy Cap, Da Nang City

2. Officials receiving dossiers examining the legality and content of the dossier:

+ If complete, valid, then receive the file, print and give a receipt, an appointment to return results.

+ If the application file is not yet valid, the receiving officer will instruct the applicant to complete the application.

Application time:

- From Monday to Saturday morning (except New Year holidays, public holidays and Sundays).

Step 3: Get results:

a) The person who receives the results of giving the receipt, identity card or passport to the officials who return the results of the examination and comparison, if there are results of temporary residence card, then request payment of fees then sign receive and hand over temporary residence cards to people who come to receive the results (even if not settled).

b) Time to return results:

From Monday to Friday weekly (except for New Year, holidays and Saturday, Sunday).

- Composition, number of records:

+ Profile component:

a) A written request for a temporary residence card (form NA6 for agencies, organizations, NA7 for individuals);

b) Application form for temporary residence card for foreigners (NA8)

c) Documents proving the eligibility for temporary residence card consideration are one of the following papers: work permit, certificate of head of representative office, member of the Board of Directors or other papers that have value proving eligible for temporary residence card;

d) 02 3x4 cm photos (01 photo to be attached to the declaration, 01 separate photo);

+ Number of files: 01 (one) set.

- Processing time: no more than 05 working days since receipt of the file.

- Subjects implementing administrative procedures: Vietnamese agencies, organizations and citizens.

- Agency implementing administrative procedures: Immigration Department, Ministry of Public Security.

- Results of administrative procedures: temporary residence card.

- Fee (if any):

+ Temporary residence card is valid for 01 year: 80 USD / 1 card

+ Temporary residence card valid for over 1 year to 2 years: USD 100 / card.

+ Temporary residence card valid for over 2 years to 3 years: 120 USD / card.

- Name of application form, declaration form (if any):

+ Official application for temporary residence card (form NA6 for agencies, organizations, NA7 for individuals);

+ Declaration of information about foreigners applying for temporary residence card (form NA8);

- Requirements and conditions for implementation of administrative procedures (if any):

1. Agencies and organizations, when applying for temporary residence cards for foreigners, must submit dossiers to prove their legal person status at the Immigration Department, Ministry of Public Security.

a) License or Decision of the competent authority on the establishment of the organization (notarized);

b) The operation registration document of the organization (notarized), issued by a competent agency of the People's Committee of the province or city directly under the Central Government;

c) Written introduction, seal, signature of the organization's legal representative;

The above submission is only made once. When there is a change in the content of the application, the enterprise must notify the Immigration Department in writing to supplement the application.

2. Foreigners on entry with the purpose of operating in accordance with the provisions of Vietnamese law, and not subject to the "suspension of exit" specified in, shall be considered for granting temporary residence cards valid from 1 five to 3 years. In the following cases, a temporary residence card is not granted:

a) Being examined for penal liability or being a defendant in civil, economic and labor disputes;

b) They are being obliged to serve criminal sentences;

c) They are being obliged to serve civil and economic sentences;

d) Being obliged to abide by decisions on sanctioning of administrative violations, tax payment obligations and other financial obligations.

- Legal grounds of administrative procedures:

+ Law on Entry, exit, transit, and residence of foreigners in Vietnam (Law No. 47/2014 / QH13, June 16, 2014).

+ Circular No. 04/2015 / TT-BCA, dated January 5, 2015 of the Ministry of Public Security, providing for forms of documents related to entry, exit, and residence of foreigners in Vietnam.

+ Circular No. 219/2016 / TT-BTC dated 10 November 2016 of the Ministry of Finance stipulating the regime of collection, remittance, management and use of fees and charges in the fields of exit, entry, transit and residing in Vietnam.
